Puppy Purchase Contract

This contract is between Joe and Marcia Blaine, herein after referred to as "Sellers" and/or "Breeders" and

___________________________________________________________, herein after referred to as "Buyer."

In consideration of payment in full of the purchase price of  S                    Dollars    ($             ) by Buyer to Sellers, Sellers agrees to transfer to Buyer, subject to the terms and conditions contained in this contract, the ownership of one Male/Female Newfoundland puppy, herein after referred to as the "Puppy" (regardless of age), from the mating of the sire and dam identified below.

Pickup/Shipping
As soon as is reasonably possible after the Puppy is eight weeks of age, Sellers will make the Puppy available to be picked up by Buyer.

Puppy Health at Pickup/Shipping
Sellers shall have the Puppy examined by a licensed veterinarian as near as feasible to the pickup or shipping date and determined to be free of disease or injury. Should the Puppy not be free of disease or injury, Sellers shall notify Buyer and pickup shall be delayed until any health problem is resolved.
  The Puppy will have first shots and will be up-to-date on worming.  Buyer should have their own veterinarian examine puppy as soon as possible  after pick-up.

Registration and Breeding
Sellers will provide Limited American Kennel Club Registration.  AKC Limited Registration means you DO NOT have breeding rights and CANNOT show this dog in Conformation Events. This dog CAN participate in all other AKC events such as Obedience, Agility, Water Work, Tracking, Carting, Search and Rescue, Therapy Work etc.  We require that the dog/bitch be spayed or neutered. This dog shall not be registered with any other registry, such as CKC.

We have known of disreputable breeders buying AKC puppies with limited registration and then using them to get CKC or other registration to breed the dog. Most of the time, those are breeders who treat dogs as livestock rather than pets. We raise our puppies to go to families as pets, therapy dogs, or service dogs and want to prevent any misuse.

 

                             Health Guarantee

Health Warranty:
Within one year of purchase Breeder agrees to take possession of this pup and replace it with another puppy of the same sex and color from the next available litter or, at the breeders discretion, refund the amount of the original purchase price, if either of the following occurs:

1. Puppy shows degenerative hip disease through a preliminary screening from OFA after 6 months of age. Severe, crippling hip dysplasia MUST be diagnosed by an OFA preliminary evaluation. This will involve your vet taking OFA XRAY films of the hips. A copy of those XRAYS is then submitted to OFA (Orthopedic Foundation For Animals) for evaluation. The OFFICIAL OFA evaluation must come back as degenerative moderate or severe hip dysplasia. A copy of the official report must be forwarded to breeder BY OFA (not by purchaser).

This entire health guarantee is null and void IF the puppy has a history of accident, abuse,  neglect OR a history of an injury resulting in ANY broken bones.

2.The puppy is diagnosed with congenital heart disease by means of either 1) clinical observation; 2) grade 3 or greater murmur; or 3) ultrasound (echocardiogram) with visual confirmation of a life-threatening disorder (not accelerated blood velocity without visual confirmation).

3. In addition we also guarantee this puppy against any life-threatening congenital disorders for 1 year from date of purchase.

Please note that this warranty does not guarantee that the pet will meet our higher heart and joint standards for breeding purposes which are not necessary for a pet to have a long, healthy, active life.

Highlander Newfoundlands will require a written description of the problem from a licensed veterinarian. We reserve the right to have the puppy examined, at our expense, by a vet of our choice within 50 miles of your home. You agree to take your pet to the vet of our choice and give them authorization to examine him/her. If a difference of opinion occurs, we reserve the right to have the puppy examined, at our expense, by a specialist in the area in question and his/her opinion shall be final. If a positive diagnosis of a life-threatening congenital defect is made, we will take possession of the pup and replace it with another puppy from the next available litter or refund the amount of the original purchase.

Any shipping/delivery charges for the replacement pup are the responsibility of the owner. Replacement with another puppy will end Highlander Newfoundlands responsibilities under this contract.

o   Buyer must provide Sellers with documentation of the inherited genetic disease;

o   The Puppy has received proper immunizations and monthly heart worm preventative.

o   The Puppy has not been allowed to become overweight.

o   The Puppy must be returned to Sellers along with the Puppy’s Registration properly signed, transferring ownership back to Sellers.

Buyer's Responsibility
Buyer agrees to conduct him/herself as a responsible dog owner.

Buyer agrees that Buyer is solely responsible for all costs and expenses of and related to the ownership of the Puppy including but not limited to feeding, veterinary care and training.

Buyer agrees that the puppy will be confined in a fenced yard at appropriate times and will NEVER be chained as a method of permanent containment. It is generally agreed that chaining your pet is one thing that has the ability to change his temperament.

Should you be unable to keep this puppy for any reason, you are required to notify Highlander Newfoundlands before surrendering this puppy to any holding facility, humane society or dog pound. If you are unable to find a suitable home, we have a wide network of prospective adoptive parents available. We will always take in any puppy or dog that was purchased from Highlander Newfoundlands and is in danger of not having a home.  If the dog is registered, he or she must be returned to the breeder with registration papers signed back over to the breeder.

By signing of this Contract of Sale, Buyer accepts all conditions contained herein. If contract is breached, the dog and AKC papers shall be returned to the breeder at the buyer’s expense.
